Working Within the Assignment

Cochran & Co. retains responsibility for the lawful and professional manner in which investigative work is conducted.

If circumstances encountered during an assignment suggest that additional work may be useful, Cochran & Co. communicates with the client as appropriate rather than treating the original scope as unlimited authorization.

Likewise, an investigative assignment does not obligate the investigator to adopt a client's theory of the case. Findings are reported according to what the investigation supports.

Witness Location & Interviews

Locating and interviewing witnesses can require a combination of research, fieldwork, communication, and careful documentation.

Cochran & Co. may assist with locating potential witnesses, establishing current contact information, conducting appropriate outreach, and performing interviews according to the assignment.

When formal interviews are conducted, the method of documentation or recording is determined according to the circumstances, applicable law, investigative purpose, and agreed scope.

Interstate or out-of-state interview and recording issues are evaluated for applicable jurisdictional requirements when necessary.

Surveillance & Field Investigation

Surveillance and field investigation may assist counsel when relevant facts depend on independently observable conduct, activities, locations, events, or circumstances.

The firm does not convert investigative observations into legal, medical, engineering, accounting, claims-adjustment, forensic, or other specialized conclusions outside the investigator's competence.

Where specialized interpretation is required, investigative information can instead be documented for evaluation by counsel or another appropriately qualified professional.

Businesses & Other Professional Clients

Cochran & Co. may also accept appropriate assignments from businesses and other professional organizations requiring investigative research, field investigation, surveillance, interviews, locates, verification, or documentation.

Assignments are evaluated individually according to objective, scope, location, required capabilities, and applicable legal or licensing requirements.

As Cochran & Co.'s professional and institutional practice develops, additional specialized service offerings may be established where the firm has the personnel, qualifications, systems, and authority to support them.

Confidentiality & Attorney-Directed Work

Cochran & Co. handles client and case information according to applicable professional obligations, engagement requirements, and law.

When an attorney retains or directs an investigator in connection with legal representation, counsel should determine the appropriate engagement structure and any privilege or work-product considerations applicable to the matter.

Cochran & Co. does not represent that investigative material is automatically protected by attorney-client privilege or the work-product doctrine merely because an attorney is involved.
